2008 Fatality: Isis Krieger, 6-Years Old, Killed by Family Pit Bull

Father Arrived from Iraq
UPDATE 08/19/08: Clarifications around Isis's death have been revealed. Medical officials declared her legally dead Thursday morning, August 14th, after undergoing surgery. Isis was then placed on life support machines while the family awaited for Isis's father, deployed to Iraq, to return to the county. Upon his return she was taken off the machines and died.

08/18/08: Isis Krieger Has Died
Anchorage, AK - 6-Year old Isis Krieger did not survive the severe injury she endured after being attacked by her family's pit bull last week in Anchorage, Alaska. Police now report that she died Thursday morning, August 14th, after undergoing emergency treatment at Alaska Native Medical Center. There are no words to describe this type of tragedy. There are only the memories of Isis that her family and friends can try to keep clasped in their hands.

People across the United States and world have been moved by Isis and her story. We have been moved by the efforts of two men, Troy Danforth and Specialist 4th Class Kyle Mayeaux of the U.S. Army Alaska, who tried to preserve her life and by the efforts of the Anchorage Police Department, the paramedics team and the emergency doctors who also tried to keep her small heart beating. Her tragedy and violent death has shaken us all.

2008 Fatality: Detroit Man Killed by Stray Pit Bull Attacking Dog

UPDATE 08/18/08: Still waiting on the media's "over-reporting" of fatal pit bull attacks. Since Howard's story was first released on August 15th, DogsBite.org appears to be the only other source that picked up the story. (robert howard, dog attack, detroit.) On the other hand, the fatality of Zane Earles, who was killed by the family's Labrador two weeks ago, has endless stories (zane earles, dog attack, tulsa).

08/16/08: Robert Howard Tried to Help
Detroit, MI - In a developing story, a Detroit man died after he was bitten by a pit bull. Police said a woman came out of her home when she saw a pit bull attacking her two chained dogs. When the woman tried to stop the attack, the pit bull went after her. She grabbed a shovel and beat the dog. Robert Howard came out of his house to help.

According to Howard's friend Isaiah Brown, "The dog had tore into his calf and when he let go, he just snatched and pulled all the arteries out. He was lying on the steps, and when I checked his vital signs he was already dead then." Police said the dog bit a main artery in Howard's leg and he later died of his injuries. Police have been unable to locate the attacking pit bull.

Loose fighting dogs are a problem in the neighborhood and witnesses believe this pit bull to be one. According to the ASPCA, "fighting dogs do not attack humans." Fighting dogs, in fact, are human friendly because dogfighters cull manbiters out of the bloodline. But famous fighting bloodlines such as, Bolio, Chinaman and Zebo were all reportedly manbiters and likely many others as well.

One more reason to distrust the ASPCA when it comes to pit bulls.

2006 Fatality: Dogsitter Killed By Pit Bull in New York

Jeannine Fusco, 44 Years Old
Airmont, NY - It was reported on October 8, 2006 that a Rockland County woman was killed after being bitten in the head and throat by a pit bull she and her sister were watching for a friend. Police said the dog violently attacked 44-year-old Jeannine Fusco in the garage of her home. The victim suffered severe bites to her throat, head and neck.

By the time officers arrived, Jeannine was already dead, and the dog had disappeared. Her sister, Valerie Wall, 43, was bitten on the leg and hand and taken to a local hospital. Police officers later found the dog in the home's backyard and killed it. Two dogs owned by the sisters, which were not involved in the attacks, were taken to the Hi-Tor Animal Care Center in Pomona, N.Y.

The two sisters lived in a split-level home and mostly kept to themselves, neighbors said. They often took in the dogs of friends or other people who could no longer care for the animals. At the mouth of their driveway was a hand painted sign reading, "Dogs at play." A coworker said that he had seen Jeannine the night before at a wedding. He described her as "incredibly dedicated, smart and lots of fun."

2006 Fatality: Cody Adair, 4-Years Old

Bartlesville, OK - On January 3rd, 2006, Cody Adair, 4-years old, was killed by his uncle's pit bull. It was reported that Cody was playing alone on the front porch before the attack. His mother, siblings, and uncle were inside. The uncle's pit bull was in the back yard, chained inside a pen. When Cody wandered too close, the pit bull attacked and killed him.

Cody was transported to Jane Phillips Hospital, but was dead on arrival with multiple dog bites. The death made front-page news in Bartlesville, where Cody's death was the first fatal attack, but only the latest in a string of violent attacks on children by aggressive dogs. The history of attacks prompted Bartlesville to start requiring licenses for all dogs, and special licenses for dogs with a history of biting.

This basic dangerous dog ordinance was not in place at the time of Cody's death. But it would not have saved Cody's life either. The pit bull that killed Cody did not have a history of biting, whereby making the new ordinance meaningless. A dangerous dog law that only takes effect after an attack does little to prevent a first attack. In the case of this pit bull, the first attack was deadly.

Previous attacks on children in the area had largely been by loose dogs. The pit bull that killed Cody was a family pet. Police were told the dog had not shown aggression in the past.

2008 Fatality: Tulsa Infant Killed by Labrador

Neglect Charges Filed
UPDATE 08/05/08: A police affidavit alleges child neglect by the 17-year-old mother whose 2-month-old son was mauled to death by a family pet. Tulsa Police allege that Linzy Earles has a history of drug abuse and was neglectful when her baby, Zane Earles, was killed by a Labrador puppy at the home of his mother and grandparents on July 28.

07/30/08: Mother Reportedly Only 17
According to the state Medical Examiner's Office, the cause and manner of Zane's death remain pending, and it could be several weeks before all of the tests are conducted and a report is completed. Police have declined to release details about Zane's injuries. Police dispatch records show that officers visited the home three times since May 2007.

07/28/08: Offending Puppy Put Down
It is reported that the offending 6-week old Labrador puppy has been put down. The puppy apparently attacked the baby as it sat in a swing inside the home. Officers say the infant, Zane Alen Earles, was alone in the room during the attack, but there was also another dog in the house (reportedly a pug) and several adults.

07/28/08: Information Sparse
Tulsa, OK - In a developing story, it appears another family dog has attacked and killed an infant. In this instance, the victim was a 2-month-old baby in Tulsa, Oklahoma. Police said the infant was mauled by a young Labrador this morning. The child died at the scene. Initial details were scant as officers continued their investigation.

2008 Fatality: Video of Millcreek Attack; English Sheepdog Statistics

Millcreek Township, PN - Police still do no know what caused the family dog (English sheepdog-mix) to attack little Addison. Her mother, Kari Sonney, was also injured in the attack. The toddler was airlifted to the Children's Hospital of Pittsburg where she later died. The death has been ruled as accidental. After the attack, the dog escaped the home. The slide show depicts officers capturing and killing the offending dog.

Occurrence of English Sheepdog Fatalities
In the dog attack statistical report compiled by Merritt Clifton, the editor of Animal People News, no fatalities by English sheepdogs and their mixes were recorded between the years of 1982 to 2007. The statistics also reveal that the combination of pit bulls and rottweilers accounted for 66% percent of fatalities. The report, Dog Attack Deaths and Maimings, U.S. & Canada, is issued each year.

Sheepdogs and their mixes are also absent in the widely quoted CDC report, Breeds of Dogs Involved in Fatal Human Attacks in the United States Between 1979 and 1998. In the report, at least 25 breeds were involved in 238 human fatalities. The combination of pit bulls and rottweilers accounted for over 50% during the 20-year span; between the years of 1997-1998, over 60%. Just last year, in 2007, pit bulls alone accounted for 60% of U.S. human fatalities.

Combining the two studies suggests that in the past 20 years, the occurrence of an English sheepdog mix attacking and killing a human being in the U.S. or Canada is zero, until the tragic death of Addison Sonney.

Fatality 2008: Mississippi Boy's Mother Discusses Fatal Dog Attack

Tony Evans Jr., 3-Years Old
Jackson, MS - On July 22nd, Chassidy Vardaman went to her front porch and called the children home. But when they came, one was missing. The family quickly began searching the neighborhood. Tony was last seen playing with some children across the street at the home of Shannon Reason. They knocked on his door to ask if he'd seen the toddler.

He hadn't, but a while later Reason walked under his carport and made a terrible discovery. He found Tony's lifeless body next to his white male pit bull. The search ended in screams for help. Vardaman tried to fight back tears as she recalled the moments before she learned her son's fate. "He was just over there playing," she sobbed. "He just wanted to play with that dog."

For most of the afternoon, neighbors strolled in and out of Reason's yard. Meanwhile, 10 children, including Tony, played out front. Vardaman said she left Tony with the other children because she had to take care of her infant son, Antonio. But she said she walked outside often to make sure Tony was OK. The last time she checked, the little boy was playing with some girls.
No one heard the attack or saw the boy being dragged into the doghouse.
Reason said he begged officers that night to kill the animal. "Kill it. Just kill it," he said. Reason doesn't want a dog anymore. He feels sympathy for the child's family, but is also upset over the way police and the media reported the attack. He said there was "no party" at his house that day and that the child wandered over to his yard when no one was watching him.

Reason said he got his dog named Blue Eyes as a guard dog. The dog was always chained and never allowed to roam, he said. "Believe me, this was no pet," he said. "I've had more stuff stolen from this driveway. You wouldn't believe it." On the front of Reason's house hangs a "Beware Of Dog" sign. He said the dog worked because it "scared people away."

Across the street, the Vardaman home is in mourning.

Questioning Dogs’ Seizure in Livingston Fatalities

Seizure of Dogs was Legal
UPDATE 07/24/08: A judge ruled that officers did not violate a Livingston County woman's rights when they seized her 10 bulldogs after the animals killed two people. The dogs were owned by 52-year-old Diane Cockrell, who has been charged with manslaughter and lesser charges in the deaths last September of Edward Gierlach and Cheryl Harper. Her trial begins Aug. 25th. If Cockrell is convicted, her attorney may use this ruling for an appeal.

07/22/08: Double Fatality Trial
Livingston County, MI - A judge is considering an attorney’s request to suppress evidence against a former Iosco Township woman facing charges in two fatal dog maulings. Police say four of Diane Ruth Cockrell’s American bulldogs killed Edward Gierlach at his cottage on Crofoot Road and Cheryl Harper, 56, while she was taking a walk along the same road. Each victim had been bitten more than 100 times.

Defense attorney Daniel Blank is asking Judge Stanley J. Latreille to rule that police and a Livingston County Animal Control officer violated Cockrell’s Fourth Amendment rights when they seized her dogs after the attack. He said the dogs were secured in a barn on Cockrell’s property and at that point, authorities needed a search warrant to go inside and get the dogs.

The hearing continues at 1 p.m. Wednesday, at which time a trial date is also expected to be set. Cockrell, 52, is charged with two counts of owning dangerous animals causing death.

2008 Fatality: Mississippi 3-Year Old Boy Killed by Pit Bull

Child Identified as Tony Evans Jr.
UPDATE 07/23/08: The 3-year old boy has been identified as Tony Evans Jr. The attack occurred as Tony was playing with friends across the street from his home. Because the pit bull was on-property and restrained (chained) during the attack, the dog owner faces no penalties. Blue Eyes is free to return home after the 10-day observation so that it can attack and kill again.

07/23/08: Homeowners Being Questioned
Police are questioning Shannon and Shaunda Reason, the owners of the home and dog named Blue Eyes. The attack occurred when the boy wandered from the front yard into the carport. As the child made the corner toward the back of the house, he met the dog face-to-face. The 2 1/2-year-old pit bull bit into the boy's neck and upper torso and dragged him inside its doghouse where he died.

Down the street, Isaac Stuckley said he heard the attack and thought someone had been shot or stabbed. He said the Reasons keep three pit bulls. Stuckley said there had been a large gathering in front of the home before the attack. Stuckley owns a pit bull as well, but he says it's for safety reasons. "That child didn't even have a chance," he said. "The whole thing makes me sick to my stomach."

07/23/08: Details Remain Sparse
Jackson, MS - In a developing story, a 3-year-old boy was killed Tuesday night in south Jackson after he was grabbed and mauled by a chained pit bull. The boy, whom police are not identifying, was taken to the University of Mississippi Medical Center.
No one else was injured.
Police spokesman Sgt. Jeffery Scott said police had to open fire on the animal because it charged animal control officers.
Police are still investigating -- no charges have been filed.
Just a few days ago in Mississippi, a woman received 1,600 stitches after a pit bull snapped its chain and bit into her leg. The incident occurred in Itta Bena. Becky Lee Grimes was attacked as she was walking through a frequently used shortcut. It took first responders three hours to catch the dog; a fireman was also bitten in the process. The case is still under investigation...

Tyler's Law: Fresno Mail Carrier Attack Could Have Been Avoided

Please Watch This Video
Mayfair, CA - Last week, a Fresno County mail carrier was attacked by four pit bulls. Had Tyler's law been properly enforced, this attack could have been avoided. Tyler's law resulted from a dog attack that killed a 6-year old boy. He was violently struck down by pit bulls already deemed "vicious." Tyler's law was designed to stop dogs from attacking more than once.
Fresno County officials have run out of excuses.
Before the loose pit bulls surrounded and attacked the postal carrier, the same dogs were involved in a series of attacks. Earlier in the month, the dogs intimidated a 77-year old woman. A neighbor said she thinks the woman is partially blind. The dogs didn't actually bite her. She had a cane and managed to fend them off. Someone heard her yelling and stepped into help as well.

Fresno police, Fresno county sheriff's deputies, and the SPCA all responded to the incident. Ten days later, the same dogs killed a neighbor's puppy, which brought a sheriff's deputy and an SPCA officer out to the house. Deputies said the SPCA was ready to seize the dogs until the owner locked himself in the house. Officials never did seize the dangerous animals.

A few days later, the same dogs attacked the postal carrier. Resident Dee Barnes, who is the grandmother of two young girls that live in the area, said, "If it had been my 5 or 7-year old granddaughter or the elderly blind lady, it would've been really bad. There could've been a fatality." One can only hope that the US Postal Service sues the County of Fresno for gross negligence.

Chrystal Babcock, the mother of Tyler, said history is repeating itself, despite the law she pushed so hard to pass. The same dogs that killed Tyler had caused problems before, but there had been a dispute about who was supposed to take action: the Sheriff's Department or the SPCA? "My son should've never died," she said. "These situations should be taken care of immediately."
But they are not taken care of...
Tyler's law was supposed to resolve issues of jurisdiction and get everybody on the same page. That's why the failure to stop these attacks frustrates her. "Because it shouldn't happen," she said. "Why did we change the laws if they're still not working?" Two of the dogs involved in the mail carrier's attack were euthanized by the SPCA. Investigators can't find the other two.

They can't find them because the owner has hidden them; a tactic often employed by the owner of dangerous dogs. It seems officials can't arrest the owner, nor can they enter into his home. The neighborhood still has 2 dangerous pit bulls to contend with as well. Agencies continue to come up with excuses, including the timeless: "We have 'low staffing' issues."
Tell that to a judge. Then tell it to the next victim's family.
To give our reading audience a "taste" of a victim's anger after a severe attack, and in the instances of a fatality, the family's anger, we share with you what is written on Tyler Babcock's Memorial page. It is a rage that bellows up from a bottomless pit. This rage cannot be contained or extinguished, particularly when gross negligence is at fault.
He [Tyler] was Killed January 2, 2005 by 2 or 3 dogs while playing in his grandparents yard where he and his father were staying while waiting for their home to be available to move in. How would you like the image of a 6-year old boy with the back of his skull and neck ripped off by two pit bulls permanently etched in your mind?

2007 Fatality: Cora Lee Suehead's Death by Pit Bulls Confirmed

Two Family Deaths Follow
Placer County, CA - Forensic tests have confirmed the cause of Cora Lee Suehead's death: four pit bulls. The 61-year old woman was found mauled to death near her home December 4th, 2007. The pit bulls were taken from her property and underwent DNA testing. The dogs belonged to a relative who had been living on the Suehead property. The dogs have since been destroyed; no charges were ever filed.

16 days after Cora's death, her 42-year old daughter, Tammy Cummins, was found dead in her Auburn home. It was believed to be a suicide. Now, for the third time in eight months, another death has touched the Suehead family. Walter Suehead, 70, Cora's husband, died of natural causes Sunday in an Auburn hospital. Officials for Chapel of the Hills in Auburn confirmed the report.

2006 Fatality: 56-year-old Pablo Rudolfo Fleites

Man Killed by Penned Male Boxer
Miami Dade, Fl - On August 30th 2006, South Florida reported it's second fatal dog attack just a few weeks apart. 56-year-old Pablo Rudolfo Fleites was found dead in the pen of a 5-year-old male boxer. The dog had the man's blood all over its body when police found the victim. The incident happened in Southwest Miami-Dade. Animal services euthanized the dog after the attack.

Police tried to learn what may have provoked the attack and why Fleites was in the dog's pen. Fleites lived on a shed on the property, which is a three-acre farm. A second dog, a 6-month-old female boxer, also was in the pen but was not believed to have been involved in the attack. Officers did not take the female dog away. Earlier in the month, a woman was killed while trying to bath her dog, a 120lb presa canario.

2006 Fatality: Shawna Willey, 30, of Coral Springs, Florida

Mauled by Family Presa Canario
Coral Springs, FL - On August 18th, 2006, a woman was attacked and killed by her presa canario while trying to give the dog a bath. Her daughter witnessed the brutal attack by the 120-pound dog and alerted a neighbor who called authorities. It was not clear what made the dog attack, according to Coral Springs Police spokesman Rich Nicorvo.

When police arrived at the house, the officers saw the dog standing over the woman's body in the backyard near the swimming pool. The dog made aggressive movements toward the officers when they entered the yard, so they shot and killed it. According to court records, Willey had been cited in Hillsborough County several years prior for having dangerous dogs.

In 2001, a San Francisco woman, Diane Whipple, was fatally mauled by two 100-pound-plus Presa Canarios outside her apartment.

2008 Fatality: Great-Grandmother Killed by Family Dogs

Lorraine May, 74-Years Old
Titusville, FL - In a developing story, a 74-year old woman was killed by her dogs. The woman suffered a dislocated shoulder and many bites. Police think May was breaking up a fight between the dogs. The animals, which she had owned since puppies, had a history of fighting with each other, and were reportedly mother-and-son.

The 11-year-old female golden-retriever mix is named Sammy, and the 6-year-old male Australian-shepherd mix is called Seth. The dogs are currently being held in separate cages at Brevard County Animal Services while the investigation continues. Animal Services had received no prior complaints about the dogs.

Autopsy results revealed Friday that May died of multiple "blunt-force trauma" caused by the dogs. A final report will not be available for about 12 weeks. May is described as a quiet lady and a fastidious dog owner who took good care of her pets. "She loved her dogs from ear to ear," said one neighbor. "You could tell the dogs brought her a lot of joy."

Pit Bull Owners Released from Jail After Fatal Attack

Bail Lowered; Owners Go Home
Breckenridge, TX - Bail for two Breckenridge residents arrested in connection with the dog-mauling death of Tanner Monk was reduced, and both have been released. Jack Smith, 45, and Crystal Watson, 27, were arrested in connection with the death of Tanner. Bail for each person was initially set at $250,000 each but was reduced to $10,000 each.
Smith and Watson live next door to the Monk family and are now headed home.
Two pit bulls attacked Monk, who was found dead on the road outside of his home. The dogs were shot after they became aggressive toward authorities. Two other dogs belonging to Smith and Watson were ordered destroyed later. Both Smith and Watson are charged with a dog attack resulting in death, a second-degree felony punishable by up to 20 years in prison and a maximum fine of $10,000.

90th District Judge Stephen Crawford issued a gag order in the case June 16th, forbidding the discussion of case details.

Fatality 2008: No Charges in Weslaco Fatal Dog Attack

CPS: A Loss of Common Sense:
Weslaco, TX - Charges will not be brought against the owner of a pit bull that mauled the his 5-year-old nephew to death. Investigators said they found no signs of negligence. Far be it for Texas investigators, including Child Protection Services (CPS), to pick up a newspaper and learn about the nine last dog attack fatalities in Texas -- eight attributed to pit bulls.
Child Protection Services did one heck of a job placing Pablo Lopez with his aunt and uncle who owned two pit bull dogs.
Witnesses said that the pit bull, Greco, flew into a rage at a dog that was walking past the family's house that night and then tackled Pablo Lopez as he walked out the back door. Witnesses said the dog tore at the boy's torso and neck, quickly killing him. Pablo's uncle offers the ever repeated and inexcusable, "All the time the dog is real nice, but this is the first time and the last time, too."
Greco snapped into "fight mode" by the simple act of a dog passing by the house. He then redirected the attack onto Pablo killing him.
Other dog breeds don't snap into "fight mode" under any circumstances unless their lives are on the line. This is because few other breeds were selectively bred to fight and to fight unforgivably until death. Child Protection Services has known about the lethal threat pit bulls pose to children for at least 15 years. Still, it was okay to place this boy in a home with two of these dogs.

After the tragic and brutal death of Pablo -- as is often the case after the fact -- Pablo's uncle tells reporters, "I hate them [pit bulls]. I don't want to see no more pit bulls in my life. I thought they would protect me and my family." As Hernandez and his wife suffer through the coming months and years at the loss of Pablo, DogsBite.org hopes they spread this same message to others.

2008 Fatality: Boy Killed by Pit Bull in Weslaco, Texas

Pablo Lopez, 5-Years Old
Weslaco, TX - Texas already carries the burden of too many deaths by pit bulls. In 2007, Texas lead the nation with 6 fatalities attributed to pit bulls and may continue to hold the deadly honor in 2008. Last night, a 5-year-old boy was mauled to death by a pit bull near the town of Weslaco (population 30,000) in Hidalgo County.
In the last 9 dog attack fatalities in Texas, 8 involved pit bulls.
The incident occurred about 8 p.m. at a home on North Beto Garcia Road, just north of the intersection of Mile 12 1/2 North and Farm-to-Market Road 88. Deputies arrived at the scene to find the child's aunt holding his lifeless body in her arms and the dog still in the front yard. The dog fled after a deputy shot and wounded it. Authorities were still trying to subdue the animal late Wednesday.
Justice of the Peace, Rosa Treviño said, "No one needs to keep these types of dogs. These dogs turn on you."
Neighbors told deputies the dog was always chained up, an assertion supported by local activist Beto Garcia -- namesake of the road where the mauling occurred. But one witness told reporters the animal was not restrained just before the incident. Officials declined to identify the boy pending notification of his mother, who resides in the state of Washington. The boy's father lives in Mexico.

Neighbors, though, identified the boy as Pablo Lopez. He had been living with his aunt and uncle after Child Protective Services placed him with them. The circumstances of that placement were not immediately known, but authorities had no record of being called out to the house before. Neighbor Luis Palomo, 20, said he was down the street playing football with his friends when the trouble began.
The boy was at home with a babysitter when a pit bull at the house began running around the front yard in an excited manner, getting a second pit bull inside the home riled up. The babysitter and boy were inside the house with the second dog and were clearly fearful, Palomo said. He went over to help them and managed to distract the dogs temporarily, but the boy wandered out the back door. One of the dogs grabbed him by the torso and dragged him. Palomo recalled hearing about 20 seconds of screaming, and then nothing. He said the dog locked its jaws around the boy's neck, quickly killing him.

2007 Fatality: Mary Diana Bernal Killed by In-Law's Pit Bull

Texas Woman Killed by Pit Bull in Florida
Deltona, FL - A pit bull that often shared a bed with its owners viciously attacked and killed a 63-year-old woman that had been visiting the family. It almost tore off the thumb of one of its owners as she tried to get the dog off her sister. It wasn't until a deputy sheriff shot the dog with a stun gun that it released its grip on the victim.

In this time, the dog had pulled off the woman's entire scalp and bitten her severely about the face. Mary Diana Bernal of Dallas, Texas, died at Halifax Medical Center in Daytona Beach, where she was airlifted after the attack in the backyard of her sister's home on Roble Lane. Her husband Rudy Bernal, was in a state of horrified shock.
"[The pit bull] was dragging her, and all her scalp was hanging by her side. He wouldn't turn her loose. He would let her go."
The attack began when Mary went into the backyard and picked up the couple's pet dachshund. Estela Macias, who tried to get the dog away from her sister, was sent to Central Florida Regional Hospital in Sanford for her injuries. "My sister-in-law is dead," she later told reporters as he wiped away tears. "I don't know what happened."

Eliasar Macias, the husband of Estela and the dog's owner, said he was stunned that his sister-in-law was killed and his wife was injured by the dog. He said that his dog never had any problems and that "he was a real friendly dog until now." He also said that the dog often slept with the two. The dog had been in bed with his wife that morning.

Animal Control found 3 adult dogs and 6 puppies in the house, including a pregnant pit bull. "Beware of Dog" signs hung on both sides of the house, but neighbors said neither Tas, the killer pit bull, nor the family's other pit bull was ever a problem. Animal Control took Tas and planned to destroy it after Marcias agreed to surrender the animal.
